1. GENERAL INFORMATION

Hereinafter, PROSAFE TOTAL SRL shall be referred to as “ProSAFE”, the “Seller”, “we” or “us”.
Use of the website and placement of an order implies acceptance of these Terms & Conditions.
2. DEFINITIONS
Customer – any natural or legal person who uses the website or places an order.
Consumer – any natural person acting for purposes outside their trade, business, craft or profession, in accordance with the applicable consumer protection legislation.
Professional Customer / B2B – any legal person or natural person acting for purposes relating to their trade, business, craft or professional activity.
Product – any item offered for sale through the ProSAFE online store.
Order – a request submitted by the Customer through the website to purchase one or more Products.
Contract – the distance contract concluded between ProSAFE and the Customer in accordance with the applicable law and these Terms & Conditions.
3. PRODUCTS AND INFORMATION PROVIDED ON THE WEBSITE
ProSAFE mainly sells personal protective equipment, safety and occupational footwear, workwear and protective clothing, gloves and other products intended for occupational safety and professional use.
We make reasonable efforts to ensure that product descriptions, images, technical specifications and other information provided on the website are accurate and up to date.
Product images are for presentation purposes. Minor differences in colour, appearance or packaging may occur due to screen settings, manufacturer updates or production batches, without affecting the essential characteristics of the Product.
Technical specifications, standards and certifications are those indicated for the respective Product and variant. Where a manufacturer changes a Product, ProSAFE may update the information published on the website accordingly.
4. PRICES
Prices displayed on the website are expressed in Romanian lei (RON).
For individual consumers, the applicable final price is the price displayed in the online store, including VAT, in accordance with applicable legislation.
Delivery charges, where applicable, are displayed separately before the Order is completed.
In the event of an obvious pricing or technical error, ProSAFE will inform the Customer before accepting the Order. The Customer may confirm the Order at the correct price or cancel it.
5. PLACING AND ACCEPTING AN ORDER
The Customer may place an Order through the online store by providing the requested information and selecting the available payment and delivery methods.
Submitting an Order through the website constitutes the Customer's request to purchase the selected Products and does not, by itself, constitute final acceptance of the Order by ProSAFE.
After submitting the Order, the Customer may automatically receive a message confirming that the Order has been registered.
This message confirms receipt of the Order in our system and does not necessarily constitute final acceptance of the Order.
The Contract is considered concluded when ProSAFE confirms acceptance of the Order to the Customer by e-mail or by another means of communication that allows the information to be stored on a durable medium.
ProSAFE reserves the right to contact the Customer to verify or clarify information relating to the Order, including Product availability, quantities, variants, delivery address or payment conditions.
6. PRODUCT AVAILABILITY
Information regarding Product availability is provided for information purposes and may depend on ProSAFE's own stock, suppliers' stocks or manufacturers' lead times.
ProSAFE does not guarantee a universal delivery or availability period of 2–7 days for all Products.
For Products that are not available for immediate dispatch, the estimated availability or delivery time will be communicated or confirmed to the Customer according to actual availability.
If an ordered Product can no longer be supplied, the Customer will be informed as soon as reasonably possible and may accept an alternative Product, a revised delivery time or cancellation of the Product or Order, as applicable.
7. PAYMENT
The available payment methods are:
– bank transfer;
– cash on delivery, where this option is available.
For payments by bank transfer, the information required to make the payment will be provided after the Order has been confirmed.
ProSAFE may request advance payment for certain Products, quantities, special orders or particular commercial circumstances, provided that the Customer is informed in advance.
8. DELIVERY
Products are delivered to the address specified by the Customer in the Order.
The standard delivery charge is RON 20, VAT included.
For Orders with a value of at least RON 500, VAT included, standard delivery offered by ProSAFE is free of charge.
Delivery times may vary depending on Product availability, quantity ordered, destination and carrier.
Any estimated delivery time communicated to the Customer does not constitute a guarantee of an exact delivery date where delivery depends on suppliers, manufacturers or carriers independent of ProSAFE.
For Consumers, the statutory delivery periods and rights provided by applicable legislation shall apply in all cases.
The Customer is responsible for providing a correct and complete delivery address and contact details that enable delivery to be carried out.
9. CONSUMER RIGHT OF WITHDRAWAL
This section applies exclusively to Consumers as defined by applicable consumer protection legislation.
Consumers have the right to withdraw from a distance Contract without giving any reason within 14 days, under the conditions provided by Romanian Government Emergency Ordinance No. 34/2014.
In the case of the sale of goods, the 14-day period generally starts on the day on which the Consumer, or a third party indicated by the Consumer other than the carrier, acquires physical possession of the Products.
The Consumer may communicate the decision to withdraw by using the return form available on the website or by sending an unequivocal statement to:

To meet the withdrawal deadline, it is sufficient for the Consumer to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Detailed conditions regarding returns, return shipping costs, refunds and any statutory exceptions to the right of withdrawal are set out in the “Returns Policy” page.
Nothing in this section limits any mandatory rights granted to Consumers under applicable legislation.
10. RETURNS FOR PROFESSIONAL CUSTOMERS (B2B)
The statutory 14-day right of withdrawal provided for Consumers does not automatically apply to purchases made by legal entities or other persons acting for professional, commercial or business purposes.
Returns requested by B2B Customers may be accepted by ProSAFE following a prior request and subject to the commercial conditions agreed for the particular case.
Acceptance of a B2B return does not create a general obligation for ProSAFE to accept other similar returns.
Products manufactured, customised, personalised, printed or specially ordered according to the Customer's requirements may be subject to specific conditions and, where applicable, may not be eligible for return.
11. CONFORMITY, WARRANTIES AND COMPLAINTS
Products sold by ProSAFE benefit from the warranties and rights provided by applicable legislation.
For Consumers, any lack of conformity of Products shall be handled in accordance with the applicable legislation governing the sale of goods and associated guarantees.
If a Customer identifies a problem with a Product, the Customer should contact ProSAFE at office@pro-safe.ro or by phone at +40 724 033 206 / +40 774 402 150 and provide the information necessary to identify the Order and Product.
To the extent permitted by law, warranties do not cover damage resulting from improper use, normal wear and tear, failure to follow the manufacturer's instructions or use of a Product under conditions other than those for which it was designed.
12. CUSTOMER RESPONSIBILITY FOR PRODUCT SELECTION
The Customer is responsible for selecting a Product appropriate for its intended use.
In the case of personal protective equipment, the appropriate equipment must be selected according to the hazards present in the workplace and the applicable risk assessment.
Information provided on the website concerning standards, protection classes and technical characteristics is intended to assist in identifying Products and does not replace a professional workplace risk assessment.
ProSAFE may provide information regarding Product characteristics, but such information does not replace the obligations of the employer or persons responsible for occupational health and safety.
13. INTELLECTUAL PROPERTY
The content of the website, including texts, graphic elements, structure, databases and other materials created by or for ProSAFE, is protected by intellectual property legislation.
Trademarks, trade names, images and materials belonging to manufacturers or suppliers remain the property of their respective owners.
Website content may not be copied, reproduced, distributed or used for commercial purposes without the consent of the rights holder, except where permitted by law.
14. PERSONAL DATA
Personal data is processed in accordance with applicable legislation and the Privacy Policy published on the website.
By placing an Order, the Customer provides the information required to process the Order, issue invoices, arrange delivery and enable ProSAFE to fulfil its legal and contractual obligations.
15. COMPLAINTS AND DISPUTE RESOLUTION
For any issue relating to an Order or purchased Products, we recommend contacting ProSAFE directly so that an amicable solution can be sought:

Consumers may contact the Romanian National Authority for Consumer Protection (ANPC) and may use the available Alternative Dispute Resolution (ADR/SAL) mechanisms in accordance with applicable legislation.
Information regarding Alternative Dispute Resolution is available on the official website of the Romanian National Authority for Consumer Protection.
If an amicable resolution cannot be reached, disputes shall be settled by the competent courts in accordance with applicable legislation.
16. AMENDMENTS TO THESE TERMS & CONDITIONS
ProSAFE may periodically update these Terms & Conditions to reflect legislative, commercial or operational changes to the online store.
The version applicable to an Order is the version in force and made available to the Customer at the time the Contract is concluded.
17. GOVERNING LAW
These Terms & Conditions are governed by Romanian law.
Nothing in these Terms & Conditions shall be interpreted as limiting any mandatory rights granted to Consumers under applicable legislation.
